Can Liquidators Extinguish a Tenants Lease?
Can a liquidator of a landlord disclaim lease agreements with the effect of extinguishing the tenant's interest in the land?
The short answer appears to be "yes", according to the Court of Appeal's recent decision Willmott Forests Ltd (Receivers and Managers appointed)(in liquidation) v Willmott Growers Group Inc and Willmott Action Group Inc  VSCA 202 ("Willmott") which overturned an earlier decision by Davies J of the Supreme Court of Victoria.
